LEGAL NOTICE
This Legal Notice sets out the legal terms and conditions governing the operation of the website hosting the webshop of Hollóházi Porcelánmanufaktúra Kft. (registered office: H-3999 Hollóháza, Károlyi utca 11., Hungary; company registration number: 05-09-026489, registered with the Company Registry Court of the Miskolc Regional Court; tax number: 24798954-2-05; hereinafter: the "Service Provider"), the information displayed on the website, and the conditions governing its use.
Please read the terms and conditions set out in this Legal Notice before using the website.
The terms governing the collection and processing of users' personal data during the use of the website, registration, and purchases, as well as visitors' rights relating to such processing, are set out in the Privacy Notice and Privacy Statement, available at:

The owner of the website hosting the Service Provider's webshop (hereinafter: the "Website"), as well as all information appearing thereon, including, in particular, all audiovisual materials and other content, together with all copyrighted works and industrial property rights embodied therein (collectively, the "Content"), is the Service Provider.
The Website has been developed and is operated by Appsters Mobiltartalom-fejlesztő Korlátolt Felelősségű Társaság(registered office: H-1023 Budapest, Lukács utca 4., 3rd Floor, Office 8; company registration number: 01-09-947838, registered with the Company Registry Court of the Budapest Metropolitan Court; tax number: 22988197-2-41; hereinafter: the "Developer"), which also acts as the hosting provider for the Content.
The Website has been established by the Service Provider for the purpose of promoting and selling the products manufactured by the Service Provider.
By using the Website, visitors (hereinafter: the "Users") accept the provisions of this Legal Notice, irrespective of whether they register on the Website. If a User does not accept these terms, the User is requested to refrain from using the Website.
The Website may contain links to third-party websites operated by independent website owners.
The Service Provider declares that, at the time such links were created, those independent websites did not, to the best of its knowledge, contain any unlawful material.
The content and information available on such third-party websites fall solely within the responsibility of their respective owners. The Service Provider neither controls nor has any influence over such websites and therefore disclaims all liability for any changes or modifications made to those websites after the relevant links were created.
1. General Conditions of Use of the Webshop
By accessing or using the Website, the User accepts and agrees to be bound by the terms set out in this Legal Notice.
The User represents that he or she is authorised to accept these terms either on his or her own behalf or on behalf of the person or entity represented.
Should any provision of these terms be declared invalid by the laws or regulations of any state or of the European Union, or by a final judgment of a competent court, such invalidity shall not affect the enforceability of the remaining provisions.
If the User does not accept these terms, the Website may not be visited and its services may not be used.
The Service Provider reserves the right, at any time, to modify or amend the content and structure of the Website and to withdraw the User's access thereto. Users are therefore advised to review these terms and conditions each time they revisit the Website.
2. Intellectual Property Rights
The Content displayed on the Website is protected by copyright and/or industrial property rights.
The Content constitutes the intellectual property of the Service Provider or of third parties who have granted the Service Provider the right to use the relevant content.
Except to the extent necessary for online viewing, the Content may not be copied or reproduced, with the sole exception of printing an entire webpage for personal use, provided that:
a) the documents and related graphics displayed on the Website are not modified;
b) graphics displayed on the Website are not used separately from the accompanying text; and
c) all copyright notices, trademark notices and other proprietary notices of the Service Provider appear on every copy.
Any copying for the purpose of distribution requires the prior written consent of the Service Provider.
For the purposes of this provision, "distribution" includes, without limitation, further use of reproduced parts of the Website, storage in databases, making the Content available for download, or placing it into commercial circulation.
Certain documents or information available on the Website may be subject to additional or different terms, which shall be expressly indicated by the Service Provider where applicable.
Without the prior written consent of the Service Provider or the respective rights holder, the User may not, in whole or in part:
copy or reproduce the Content;
modify the Content;
rent, lease or sell the Content;
create derivative works;
upload, transmit or distribute the Content.
Furthermore, the publication of any intellectual property displayed on the Website in any medium, whether in its original or modified form, without the prior written consent of the Service Provider or the relevant rights holder, is prohibited.
Any use of Content obtained from the Website that is inconsistent with these terms is prohibited.
Unless otherwise expressly indicated, all Content displayed on the Website shall be deemed to be protected by copyright and/or industrial property rights and may not be used without the prior written consent of the Service Provider.
Any use of images other than as expressly permitted by this Legal Notice or applicable law constitutes an infringement of rights and may give rise to legal consequences.
3. Access to the Website
The Service Provider endeavours to ensure that the Website is available twenty-four (24) hours a day. However, the Service Provider accepts no legal liability for any temporary unavailability of the Website. The Service Provider reserves the right, without prior notice to Users, to suspend access to the Website or the User's right of access at any time and for any duration due to system failures, maintenance, repairs, or any other circumstances temporarily affecting the proper operation of the Website.
4. Conditions Governing Information Uploaded by Users
Where the Service Provider permits Users to upload data or other information to the Website, other than personal data governed by the Privacy Notice and Privacy Statement, the User waives ownership rights in respect of such uploaded information, and the Service Provider shall be entitled to use such information.
The Service Provider assumes no responsibility or liability for information uploaded by Users.
Users are solely responsible for ensuring that they possess all necessary rights and permissions relating to the uploaded information. The Service Provider accepts no liability for unauthorised uploads.
Users are prohibited from uploading content that is: obscene; defamatory; threatening; hateful; infringing personality rights; pornographic; or otherwise unlawful or constituting a criminal offence.
Users are also prohibited from uploading information which they are not entitled to disclose or from uploading or making available applications that may endanger the electronic systems or data of the Service Provider, the Developer or other Users, including viruses, spyware, worms or similar malicious software.
The Service Provider reserves the right, where misuse is suspected, to remove uploaded information without the User's consent or, where necessary, to forward such information to the competent authorities for the investigation of unlawful conduct.
The Service Provider is under no obligation to maintain backup copies of information uploaded by Users and accepts no liability for the loss, alteration or damage of such information.
By uploading information, the User acknowledges and accepts the foregoing.
If a User breaches these terms, the Service Provider shall be entitled to suspend or permanently revoke the User's access rights, initiate the appropriate legal proceedings where applicable, and claim compensation for any damages suffered.
5. Accuracy of Information, Currency and Limitation of Liability
All information published on the Website is intended to assist Users, provide information and facilitate purchases.
The Service Provider uses all reasonable efforts to ensure that the information available on the Website is accurate and up to date. Nevertheless, it accepts no responsibility for any inaccuracies.
The information available on the Website is provided for informational purposes only and is made available "as is", to the fullest extent permitted by law, without any warranty, guarantee or other undertaking.
To the maximum extent permitted by applicable law, the Service Provider excludes all liability, warranties, guarantees and similar obligations arising from inaccuracies contained on the Website that would otherwise apply in the absence of this disclaimer.
The Service Provider further gives no warranty regarding:
the uninterrupted operation of the Website;
the absence of harmful elements;
the continuous availability of the services offered through the Website,
although it undertakes to use all reasonable efforts to ensure uninterrupted operation and to remedy any errors promptly.
The Service Provider cannot guarantee that the Content and services available through the Website will be compatible with every electronic device or software environment used by Users.
To the fullest extent permitted by law, the Service Provider shall not be liable for any direct, indirect or consequential damages arising from the foregoing, including, without limitation:
costs incurred; loss of profits; financial losses; interruption of business; damages resulting from the use of the Website; or damages resulting from the use of websites accessible via links published on the Website, except where the exclusion or limitation of liability is expressly prohibited by applicable law.
The limitation of liability contained in this section shall not apply to statutory warranty rights relating to Goods sold through the Webshop.
6. Mixed Provisions
Ownership of the copyright-protected source code of the Website is retained by the Developer. For the purposes of this provision, "source code" means every part or element of the Website that has not been created by the Service Provider or by Users. The Developer assumes no responsibility whatsoever for the Content displayed on the Website. Any legal dispute arising in connection with the Website shall be governed by the laws of Hungary and applicable European Union law.
